Terms of Service

3.1 Account Creation

To use certain features of Podit, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree not to share your account credentials with others or allow others to access your account.

5.1 Ownership of User-Generated Podcasts

This means that all podcasts created through our Service become the exclusive property of Podit, and we own all copyrights, trademarks, and other intellectual property rights in such content.

5.2 License to Use Your Content

In addition to the ownership rights described above, you grant Podit a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display any content you submit to the Service (including but not limited to your profile information, comments, and other interactions).

5.3 Your Representations and Warranties

By creating content on Podit, you represent and warrant that:

• You have the right to create and submit the content
• Your content does not infringe any third-party intellectual property rights
• Your content complies with all applicable laws and these Terms
• You understand and accept that ownership of created podcasts transfers to Podit

5.4 Podit's Intellectual Property

The Service, including its software, text, graphics, logos, icons, images, audio clips, digital downloads, and data compilations, is the property of Podit or its licensors and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our explicit written permission.

6.1 Acceptable Use

You agree to use Podit only for lawful purposes and in accordance with these Terms. You agree not to:

• Create podcasts that contain illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable content
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Upload, post, or transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights
• Upload, post, or transmit any unsolicited or unauthorized advertising, promotional materials, spam, or any other form of solicitation
• Upload, post, or transmit any material that contains software viruses or any other computer code designed to interrupt, destroy, or limit functionality
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Violate any applicable local, state, national, or international law
• Collect or store personal data about other users without their consent
• Use the Service to create content that promotes violence, discrimination, or hatred against individuals or groups
• Engage in any form of harassment, bullying, or intimidation of other users
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
• Use automated means (including bots, scrapers, or spiders) to access the Service without our prior written permission

6.2 Content Moderation

Podit reserves the right, but is not obligated, to:

• Monitor, review, and moderate all content submitted to the Service
• Remove or refuse to post any content that violates these Terms or that we find objectionable
• Take any action with respect to user-generated content that we deem necessary or appropriate

6.3 Reporting Violations

If you encounter content or user behavior that violates these Terms, please report it to us at podit.podcast@gmail.com.

7.1 Our Right to Suspend or Terminate

We reserve the right to suspend or terminate your account and access to the Service, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Prolonged inactivity
• At our sole discretion if we believe suspension or termination is necessary to protect the Service or other users

7.2 Banned Users

Users who engage in problematic behavior, violate these Terms, or pose a risk to the community may be permanently banned from the Service. Banned users may not create new accounts or access the Service through alternative means.

7.3 Effect of Termination

Upon termination of your account:

• Your right to access and use the Service will immediately cease
• We may delete your account and any content associated with it
• All licenses and rights granted to you under these Terms will immediately terminate
• Podit retains all ownership rights to podcasts created through the Service

7.4 Your Right to Terminate

You may terminate your account at any time by contacting us at podit.podcast@gmail.com. Please note that termination of your account does not affect Podit's ownership of podcasts you created while using the Service.

8.1 Nature of AI-Generated Content

Podit uses artificial intelligence technology to assist in creating podcast content. You acknowledge and agree that:

• AI-generated content may not always be accurate, complete, or appropriate
• AI systems can produce unexpected or unintended results
• You should review all AI-generated content before publishing
• Podit is not responsible for the accuracy or quality of AI-generated content

8.2 User Responsibility

You are responsible for reviewing and ensuring that any podcast you create and publish through the Service is appropriate and complies with these Terms, even if the content was generated with AI assistance.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. Accordingly, some of the above limitations may not apply to you.

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration or in the courts of Turkey, as appropriate.

15.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Podit regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Podit's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice to you.

16.5 Force Majeure

Podit shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

16.6 Survival

Sections regarding intellectual property rights, disclaimers, limitation of liability, indemnification, and general provisions shall survive any termination of these Terms.
